LuxLoveLouis Consignment Agreement

Consignment Terms (Updated & Enforced)
- 90-Day Consignment Period: Items are listed for a 90-day cycle. If unsold after 90 days, items may be extended or retrieved. If no response is received by day 90, items continue being listed automatically.
- Pricing & Adjustments: LuxLoveLouis may adjust pricing based on brand performance, demand, condition details, and competitive market data. Adjustments may occur weekly, and notifications will be provided.
- Authentication Requirements: All items must complete authentication prior to listing. Authentication fees are non-refundable. Counterfeit submissions incur a $275 fee and must be picked up within 14 days or will be securely disposed of.
- Early Retrieval: Retrieving an item before the 90-day term incurs a $175 early return fee (plus authentication and shipping charges).
- Return Fee for Unsold Items: If retrieved after 90 days without sale, a 12% unsold return fee applies to cover marketing, photography, and platform costs.
- Shipping, Insurance & Liability: Return shipping is paid by the consignor. LuxLoveLouis is not liable for carrier-related loss or damage. Additional insurance may be purchased. International shipment compliance follows our Commercial Invoice standards.
- Payout Schedule: Payouts for sold items are issued on the 15th and 30th (or next business day) via Zelle, PayPal, or mailed check.
- Ownership & Authenticity: Consignor confirms they are the legal owner of all items. Items under investigation for fraud, theft, or authenticity disputes may be withheld or returned at LuxLoveLouis’ discretion.
- Photography & Marketing Rights: Consignor grants LuxLoveLouis the right to photograph, edit, and market items across online platforms. Images may remain in our portfolio after sale.
- Identity Verification: LuxLoveLouis may request government ID or proof of purchase to prevent fraud. Non-compliance may result in removal from the program.
- Chargebacks & Payment Disputes: Filing a dispute or chargeback for consignment services is prohibited and constitutes breach of agreement. LuxLoveLouis reserves the right to restrict future access.
- Fraud, Misrepresentation & Misuse: Providing stolen goods, counterfeit items, false details, or attempting to manipulate sale processes may result in immediate termination and potential reporting to authorities.
- Final Sale Policy: All consignment sales made by LuxLoveLouis are final sale. Returns are not permitted unless an authenticity issue is validated by LuxLoveLouis.
- Arbitration Agreement: Disputes arising from this Agreement will be resolved exclusively through binding arbitration in Charleston, SC, under FAA guidelines. Class actions and jury trials are waived.
- Governing Law: This agreement is governed by South Carolina law and relevant federal regulations.
